When you are facing a DUI charge, there are two (2) driver’s license suspensions at play. One is a civil suspension of your driving privileges through the Idaho Transportation Department and one is a suspension through the court if there is a conviction for the criminal charge.

Civil Suspension

The suspension of your driving privileges through the Idaho Transportation Department is a civil suspension issued if you refuse to submit to an evidentiary test, fail to complete an evidentiary test, or fail an evidentiary test. Idaho Code § 18-8002A. If you are charged with Driving Under the Influence (DUI) in Idaho, you have the right to request a hearing within seven (7) days of receiving the notice of suspension of your driver’s license. That notice is issued to you at the time you are cited for Driving Under the Influence (DUI). If you do not request a hearing, the Idaho Transpiration Department will suspend your license for ninety (90) days if it is your first failure of an evidentiary test.

Criminal Suspension

The suspension most people consider when facing a DUI is the suspension of your driving privileges if there is a conviction for the charge. This suspension is done by the court in accordance with Idaho Code § 18-8005. If it is your first DUI, a conviction brings a driver’s license suspension of one hundred eighty (180) days, the first thirty (30) of which is absolute and no driving privileges are allowed. After that you can apply to the court for limited driving privileges.
